Prior to the conclusion of the distance contract, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be viewed at the entrepreneur&#8217;s premises and will be sent to the consumer free of charge upon request as soon as possible.<br \/><\/span><span style=\"font-size: 14px;\">3. If the distance contract is concluded electronically, in deviation from the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that the consumer can easily store them on a durable medium. If this is not reasonably possible, it will be indicated before the distance contract is concluded where the general terms and conditions can be viewed electronically and that they will be sent to the consumer free of charge upon request, either electronically or by other means.<br \/><\/span><span style=\"font-size: 14px;\">4. If alongside these general terms and conditions, specific product or service conditions also apply, the second and third paragraphs shall apply mutatis mutandis, and the consumer can always invoke the provision that is most favorable to them in case of conflicting general terms and conditions.<br \/><\/span><span style=\"font-size: 14px;\">5. If one or more provisions in these general terms and conditions are null and void or are annulled at any time, the remaining provisions of the agreement and these terms and conditions shall remain in full force and the null and void or annulled provision(s) shall be replaced without delay by a provision that reflects the purpose of the original provision(s) as closely as possible.<br \/><\/span><span style=\"font-size: 14px;\">6. Any situations not regulated by these general terms and conditions shall be assessed in the spirit of these general terms and conditions.<br \/><\/span><span style=\"font-size: 14px;\">7. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer. If the entrepreneur makes use of images, these will be a true representation of the products and\/or services offered. Obvious errors or mistakes in the offer do not bind the entrepreneur.<\/span><\/p>\n<\/li>\n<li>\n<p><span style=\"font-size: 14px;\"><\/span><span style=\"font-size: 14px;\">Each offer will contain such information that it is clear to the consumer what rights and obligations are attached to accepting the offer.<\/span><\/p>\n<\/li>\n<li>\n<p><span><\/span><span>If an offer has a limited duration or is made subject to conditions, this will be explicitly stated in the offer<\/span><\/p>\n<\/li>\n<\/ol>\n<\/div>\n<\/section>\n<\/div>\n<div class=\"flex_column av-10hxt4-1c58da888692c1e661289b86c61d9ea4 av_one_full  avia-builder-el-25  el_after_av_one_full  el_before_av_one_full  first flex_column_div av-zero-column-padding column-top-margin\">\n<section class=\"av_textblock_section \" itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\">\n<div class=\"avia_textblock  \" itemprop=\"text\">\n<h1><strong><\/strong><\/h1>\n<h1><strong>Article 5 \u2013 The contract<\/strong><\/h1>\n<\/div>\n<\/section>\n<section class=\"av_textblock_section \" itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\">\n<div class=\"avia_textblock  \" itemprop=\"text\">\n<ol>\n<li>\n<p><span>The contract shall be concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and meets the corresponding conditions.<\/span><\/p>\n<\/li>\n<li>\n<p><span><\/span><span style=\"font-size: 14px;\">If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by the entrepreneur, the consumer may terminate the contract.<\/span><\/p>\n<\/li>\n<li><span><\/span><span>If the contract is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment. If the consumer can pay electronically, the entrepreneur will observe appropriate security measures.<\/span><\/li>\n<li><span><span style=\"font-size: 14px;\">The entrepreneur can, within legal frameworks, gather information about the consumer&#8217;s ability to fulfill their payment obligations, as well as all facts and factors relevant to responsibly concluding the distance contract. If, based on this investigation, the entrepreneur has good reasons not to enter into the contract, they are entitled to refuse an order or request, providing reasons, or to attach special conditions to the implementation.<\/span><\/span><span><br \/><\/span><\/li>\n<li>\n<p><span><\/span><span>The entrepreneur shall send the following information with the product or service to the consumer, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable medium:<\/span><\/p>\n<ol>\n<li><span> the visiting address of the entrepreneur&#8217;s business location where the consumer can go with complaints;<\/span><\/li>\n<li><span> the conditions under which and the manner in which the consumer can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;<\/span><\/li>\n<li><span> information about after-sales service and warranties;<\/span><\/li>\n<li><span> the price including all taxes on the product or service, where applicable, the costs of delivery, and the method of payment, delivery, or implementation of the distance contract;<\/span><\/li>\n<li><span> the requirements for canceling the contract if the contract has a duration of more than one year or is of indefinite duration;<\/span><\/li>\n<li><span> if the consumer has a right of withdrawal, the model withdrawal form.<\/span><\/li>\n<\/ol>\n<p><span>In the event of a continuing performance contract, the previous paragraph only applies to the first delivery.<\/span><\/p>\n<\/li>\n<\/ol>\n<\/div>\n<\/section>\n<\/div>\n<div class=\"flex_column av-xryvo-338d220100071ed848f7f86754e61385 av_one_full  avia-builder-el-30  el_after_av_one_full  el_before_av_one_full  first flex_column_div av-zero-column-padding column-top-margin\">\n<div class=\"avia-image-container av-www4o-b64f406565abc7b29f3bd94160e2c410 av-styling- avia-align-center  avia-builder-el-31  el_before_av_hr  avia-builder-el-first  \" itemprop=\"image\" itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/ImageObject\">\n<div class=\"avia-image-container-inner\">\n<div class=\"avia-image-overlay-wrap\"><\/div>\n<\/div>\n<\/div>\n<div class=\"hr av-wnnew-4f998dd35ed1c49315fdae7e42a32a3e hr-invisible  avia-builder-el-32  el_after_av_image  el_before_av_textblock  \"><span class=\"hr-inner \"><span class=\"hr-inner-style\"><\/span><\/span><\/div>\n<section class=\"av_textblock_section \" itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\">\n<div class=\"avia_textblock  \" itemprop=\"text\">\n<h1><strong><\/strong><\/h1>\n<h1><strong><\/strong><\/h1>\n<h1><strong><\/strong><\/h1>\n<h1><strong>Article 6 \u2013 Right of Withdrawal<\/strong><\/h1>\n<\/div>\n<\/section>\n<section class=\"av_textblock_section \" itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\">\n<div class=\"avia_textblock  \" itemprop=\"text\">\n<p><span>For products:<\/span><\/p>\n<p><span>1. The consumer can terminate an agreement regarding the purchase of a product during a reflection period of at least 14 days without giving reasons. The entrepreneur may ask the consumer about the reason for the withdrawal but cannot oblige them to state their reason(s).<br \/><\/span><span>2. The reflection period mentioned in paragraph 1 starts on the day the product is received by the consumer or a representative designated in advance by the consumer and announced to the entrepreneur.<br \/><\/span><span>3. If the consumer has not been provided with the legally required information about the right of withdrawal or the model withdrawal form, the reflection period expires twelve months after the end of the original reflection period, as determined in accordance with the previous paragraphs of this article.<br \/><\/span><span style=\"font-size: 14px;\">4. If the entrepreneur has provided the consumer with the information referred to in the previous paragraph within twelve months after the starting date of the initial reflection period, the reflection period will expire 14 days after the day on which the consumer received that information.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<\/section>\n<\/div>\n<div class=\"flex_column av-uqa9o-1e259306bb544e1e29b3868145e64ea7 av_one_full  avia-builder-el-35  el_after_av_one_full  el_before_av_one_full  first flex_column_div av-zero-column-padding column-top-margin\">\n<section class=\"av_textblock_section \" itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\">\n<div class=\"avia_textblock  \" itemprop=\"text\">\n<h1><strong><\/strong><\/h1>\n<h1><strong>Article 7 \u2013 Consumer&#8217;s Obligations during the Reflection Period<\/strong><\/h1>\n<\/div>\n<\/section>\n<section class=\"av_textblock_section \" itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\">\n<div class=\"avia_textblock  \" itemprop=\"text\">\n<ol>\n<li>\n<p><span>During the reflection period, the consumer shall handle the product and packaging with care. They shall only unpack or use the product to the extent necessary to determine the nature, characteristics, and functioning of the product. If there is a delay in delivery or if an order cannot be executed or can only be partially executed, the consumer will be notified of this no later than 30 days after placing the order. In such cases, the consumer has the right to dissolve the agreement free of charge. The consumer is not entitled to any compensation.<\/p>\n<\/li>\n<li>\n<p>All delivery times are indicative, and the consumer cannot derive any rights from any stated deadlines.
